1. Welcome
Welcome to Deathwishes. We built this service to make hard conversations easier. These Terms of Service are a legal agreement between you and Deathwishes. By using our website or mobile app, you agree to follow these rules.
2. Who Can Use Deathwishes
To use Deathwishes, you must:
Be located in the United States
Be at least 18 years old
Agree to use the app only for lawful, personal purposes
You must also:
Keep your login information secure
Not impersonate anyone or submit false or harmful information
Not use Deathwishes in any way that promotes or encourages self-harm
3. Your Content
You own the content you enter into Deathwishes.
When you use the service, you give us permission (a license) to securely store, process, and display your entries so that the app works correctly for you. We do not sell your content. You are responsible for making sure what you submit is legal and accurate.
4. Account Deletion and Termination
You may delete your account and data at any time using the in-app setting (Profile > Settings > Delete Account and Data) or by contacting us at contact@deathwishes.com.
We may suspend or terminate accounts that violate these terms or are used in a harmful or illegal way.
5. Intellectual Property
All content and branding (other than what you submit) belongs to Deathwishes. You agree not to copy, modify, or redistribute any part of our website or app without permission.
6. Privacy
Our Privacy Policy explains how we collect and use data. It’s part of these Terms. Please review it carefully.
7. Third-Party Services
We use trusted services to make Deathwishes work:
Firebase, RevenueCat, Branch, Amplitude, Customer.io, Cloudflare, Stripe, Apple/Google Pay
These tools help us with storage, subscriptions, notifications, analytics, and payment. Each service has its own terms and privacy policies.
8. No Legal or Medical Advice
Deathwishes is not a substitute for legal, financial, or medical advice. Nothing you enter here creates a legally binding will unless you follow applicable legal processes outside of the app.
9. Disclaimers
We do our best to provide a secure, reliable experience. But:
We can’t guarantee uninterrupted access or that the app is free of bugs.
We provide the service “as-is” without warranties of any kind.
10. Limitation of Liability
To the fullest extent allowed by law, Deathwishes and its team are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid (if any) in the 12 months before a claim.
11. Indemnity
If your use of Deathwishes causes legal trouble for us (e.g., you upload illegal content), you agree to cover our costs, including attorney fees.
12. Modifications
We may update these Terms from time to time. If changes are significant, we’ll let you know via email or in-app alert.
13. Governing Law
These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of Travis County, Texas.
